A Tractor Fender is No Place for a Will
So, my Mom was right. When you're traveling in the winter you really do need to wear winter boots and have an emergency kit in the trunk. That lesson was learned the hard way by hundreds of travelers when a snowstorm unexpectedly shut down the Transcanada Highway between Calgary and Medicine Hat for three days in January. The weather was so bad that neither tow trucks nor the RCMP could get to the stranded travelers. What made it even worse, was that some of the stranded travelers didn't have any winter clothes with them because they were on their way to the airport to catch a flight for a winter vacation. Things were looking so desperate that one traveler said he had started to dictate his last wishes into his iPhone!
Unfortunately for ″the dictator″, technology was not going to be of much help to him in preparing a will from his stranded vehicle. Oral wills are not recognized in Alberta, BC or Saskatchewan. Typing his will into his iPhone wasn't going to do him any good either, unless he had a way of printing it in his vehicle and two witnesses in the back seat who could sign it (rather unlikely given that he didn't even bring pants). A good old pen and paper would have been his best chance of preparing a valid will alone in his car.
So what forms of wills are valid?
Handwritten Wills
In Alberta and Saskatchewan, a will that is 100% in your handwriting and signed by you alone can count as a legal will. Completely handwritten wills are known as holograph wills.
Saskatchewan is known for a rather famous holograph will. In 1948, a farmer who got trapped under his tractor carved the following into the tractor's fender: ″In case I die in this mess I leave all to my wife.″ Then he carved his name. The writing carved into the fender was recognized by the courts as a valid will. Clearly, this example is extreme and should not be repeated!
Typed Wills
A typed will needs to be signed by you and the signing of your will needs to be witnessed by two people. Your witnesses do not need to read your will, but you all need to all be present in the room at the same time and see each other sign the will.
The witnesses should not include someone who is or could be a beneficiary under your will or the spouse/common law partner of someone who is or could be a beneficiary under your will. If a beneficiary or their spouse witnesses your will, the will will still be valid, but that witness will not be allowed to receive what you had left them in the will.
Partly Typed, Partly Handwritten Wills
If any part of your will is not in your handwriting, two people need to witness you signing your will. If you sign it without witnesses, only the parts of the will that are in your handwriting will be recognized by the court as forming your will. Out of context, the handwritten parts probably won't make a whole lot of sense.
Oral and Videotaped Wills
Oral and videotaped wills make for good scenes in movies, but they are not recognized as a valid form of will in Alberta, Saskatchewan or B.C.
If you go through the process of making a will, you might as well make sure the final product is going to hold up in court. There's not a lot of room for creativity when it comes to what format you can use to record your wishes, which is a good reason not to wait until you are stuck under a tractor or on the side of the highway to make your will! (Mom - What do you want to bet ″the dictator″ still hasn't made a will, or put an emergency kit in his trunk?)
By the way - for those of you who are thinking the ″will on a fender″ idea was awesome, keep this in mind - the family had to haul that fender into court. Talk about looking like a redneck at the courthouse! Apparently the fender is still on display at the law library at the University of Saskatchewan. I don't know how much a tractor fender costs, but I'm pretty sure would have been cheaper to have a lawyer draft the will on paper instead!
*Wills legislation in Alberta, Saskatchewan and B.C. allow for different witness requirements for wills made by military personnel who are on active service.
