I rented a car for my girlfriend which I never did before but i felt sorry for her. It was hard for her to get back and forth to work and take 3 kids to school. Her previous car was totaled in a car accident by a tractor trailer. So needles to say i rented her a car and her boyfriend gets in an accident with it. So by the time we went to the pound for the car and her boyfrind gets locked up for running from the cops. the rental people said the damages were 1158.00 She said she was going to pay for the damages cause she was getting her taxes in a couple of weeks. Well to make a long story short,she hasn't called she hasn't returned any of my calls and of course i'm stuck paying for these damages. I never put her on the contract as a authorized driver so now they have to look at my insurance. My insurance was willing to pay for it and I pay the $500 deductible. But I feel she still owes me. Do i have a chance by taking her to court?????
Wow, you are LUCKY your insurance is willing to pay. Normally if YOU weren't driving, YOUR insurance wouldn't cover the rental. I have seen this situation before & coverage was denied. Even the insurance of the driver didn't extend because it was not permissive use, meaning the driver was NOT on the rental contract therefore didn't have permission to drive the car. You could have been on the hook for the whole amount of the damages. I am sure if your insurance company will go after the driver for the damages & will return your deductible to you once they collect.
If you want to take someone to small claims, you probably will have to take your friend AND her boyfriend to try to collect. You will likely get a judgement but good luck in collecting anything.
At least if your company attempts to collect, they have attorneys on staff to do this, they have the time & the means to do this for you.
